TREEHOUSES AT ELMORE COURT ESTATE CANCELLATION POLICY

CANCELLATION

• We understand that your plans may change, and so you have the right to cancel your booking with Elmore Court at any time.  To do so, you must let us know in writing, and your cancellation will be subject to payment of the following cancellation fees, depending on when we hear from you:
• Where cancellation is received 60 days or more in advance of the start of your booking: you will receive a full refund of the payment we have received from you, less a cancellation fee of £50.00. 
• Where cancellation is received less than 60 days before the start of your booking: we will try and re-sell the booking for you. If we do, you will receive a full refund less a cancellation fee of 15% of the payment we have received from you. If we are not able to re-sell the booking at this short notice, then there will be no refund.
• Where cancellation is received within 7 days of the start of your booking: there is no refund. In order to cover unforeseen circumstances, we strongly recommend you take out cancellation insurance or check your annual travel insurance policy, to make sure that you are covered should you need to cancel for any reason.
• We also have the right to cancel your booking with Elmore Court at any time.  If we do so, you will be provided with a full refund of all amounts which you have paid to us in advance in relation to this booking.  
• For the purposes of these terms and conditions, a Force Majeure Event means an event beyond the reasonable control of Elmore Court, including but not limited to strikes, lock-outs or other industrial disputes, failure of a utility service or transport network, act of God, sickness, epidemic, pandemic, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or other adverse weather conditions or default of third parties.  Elmore Court shall not be liable to you as a result of any delay or failure to perform our obligations in relation to your booking as a result of a Force Majeure Event.
• We shall notify you as soon as reasonably possible where we know or reasonably suspect that your booking cannot go ahead because of a Force Majeure Event,   following which we will offer a number of alternative dates from which you may select to re-schedule your booking, at no additional charge.  The new dates you select shall be confirmed by Elmore Court in writing, and after this, your booking will be varied to reflect these new dates.  No refunds will be given if you fail to agree to an alternative date.  
• Where Elmore Court is unable to offer you suggested alternative dates for your booking due to a Force Majeure Event, Elmore Court may in our absolute discretion cancel your booking and will fully refund you all amounts which you have paid to us in advance in relation to this booking. 

TREEHOUSES AT ELMORE COURT TERMS AND CONDITIONS

Please have a proper read, as we want to let you know how we do things so that you know what to expect and enjoy your stay in our treehouses.

1. MAKING A BOOKING

1.1 These terms and conditions will govern the booking which you have made to stay in one of our treehouses at Elmore Court, and are between you, the individual making the booking, and Anselm Guise, trading as Elmore Court, based at Elmore Court, Elmore, Gloucestershire, GL2 3NT.

1.2 You must be 18 years of age or over to book accommodation and stay at one of our treehouses.

1.3 Bookings must be made for a minimum of 2 nights. All bookings must be paid in full at the time of booking. Your payment card details will be taken at the time of booking, and your booking will be treated as provisional until we have received full pre-payment from you of the rate for your stay, and you subsequently receive a confirmation email from us which states that the booking is now confirmed.

1.4  A link to a copy of these terms and conditions will be referenced and displayed on the booking engine, and you confirm that you have read a copy of these, and agree to be bound by them, before making your booking and may be emailed to you on request.

1.5  The advertised rate for your booking does not include any incidental charges which you may incur during your stay (as set out in section 3 (late check-out) and section 12 (damage and cleaning) below), or any optional extras which you may request (as set out in section 5 below).   If applicable, these will be payable on departure in addition.

1.6  Your booking, once confirmed by us, is a limited licence to enter, occupy and use the treehouse for the number of nights which you have booked. Elmore Court retains the right to re-enter the accommodation during your stay, to the extent required to ensure your safety and comfort.

2. CANCELLATION

3.  ARRIVAL & DEPARTURE TIMES

3.1  We will do our best to make sure that your accommodation is ready by 3pm on the day of arrival and your treehouse(s) must be vacated by 11am on the day of departure. We will be entitled to charge you for late check-out if your treehouse(s) has not been vacated by this time.

4.  RATES

4.1  The accommodation rate for your booking will be as quoted on the website at the time of your booking and the price stated on your booking confirmation will be the amount deducted from your card details provided. We do however reserve the right to alter our advertised rates at any times.

4.2  The following are included in the rate:

4.2.1  SLEEPING: Super king size bed with pillows & duvet, all cotton bedlinens and blanket. All treehouses (except ‘Wren’) have a pull-out single trundle bed under the super king enabling a third guest to stay. ‘Sky’ and ‘Earth’ also have a day bed meaning that these treehouses can sleep four adults. Linen will be provided according to the numbers made when booking on-line.

4.2.2  COOKING & EATING• :  For all treehouses (apart from ‘Wren’), the outdoor kitchen includes: single gas hob, fridge, dining area, chopping board. Indoors is a microwave combi-oven, kettle. ‘Wren’ has an entirely indoor kitchen with double induction hob, fridge, dining area, work surface.  All treehouses have a selection of pots, pans, crockery, glasses and cutlery. We also provide teas/coffee, sugar, salt/pepper, olive oil, vinegar, kitchen roll, and a ‘One Pot’ recipe book.

4.2.3  BATHING: Elmore Court bathroom products (shampoo, conditioner, body wash and body lotion) Loo roll. Outdoor Bath.

4.2.4  RELAXING: Seats on decking, fur throws, wood burner indoors and brazier outdoors (both with an initial supply of seasoned logs for your stay).

4.2.5 CONVENIENCE: Wifi, Welly Stand, Dustpan and brush, Broom, Torch, Umbrella, Hair dryer, Iron & mini ironing board, maps and guide of where to go and eat, shop and visit in the area.

4.2.6  ELECTRIC CAR CHARGING: Each treehouse has its own exclusive car park which provides access to an electric car charger. However, please note that use of this car charger will be at your cost and is not included in the rate.

5.  EXTRAS

5.1   Elmore Court is able to provide a number of additional extras to be provided for your stay in the form of food, drinks, additional wood supply and activities. Please make sure to select and pre-order these when booking online so that we can make sure that we have these available for you.

6.  SAFETY AND SURROUNDINGS

6.1  By booking to stay in one of our treehouses, you understand and accept that it is rustic and natural accommodation, with limited signage to enable you to relax and make the most of being in the countryside. Each treehouse has its own exclusive boardwalk which is lit by a motion sensor activated light at night. However, you are fully responsible for your own safety at all times.

6.2 All members of your party must act with integrity, treat others with respect and comply with applicable laws at all times. This includes being respectful of the other treehouse guests, and our surrounding neighbours, and we ask that noise is kept to a minimum.

7.  WHEELCHAIRS/BUGGIES/DISABLED ACCESS

7.1  “Sky” is the only treehouse without steps and as such has disabled access and can be used by those with wheelchairs and buggies. The outdoor kitchen has also been lowered to make cooking easier. We have endeavoured to make the space as accessible as possible but please note that this is still a rural stay, and we would suggest that you (or one of your party) come and visit us to make sure that it is suitable for your needs if you have any concerns. Elmore Court cannot provide any guarantees in this regard.

8.  DOGS

8.1  Sadly, we do not allow guests to bring dogs with them due to the wildlife in the woods and livestock in the surrounding fields.

9.  CHILDREN

9.1 We are aware that you may wish to include guests in your booking who are children.  Children are very welcome to join your treehouse stay, but please note that if you are booking for an additional guest who is a child, you are solely responsible for the supervision of that child at all times, and for highlighting to them the potential dangers of being in a woodland setting.

9.2  Elmore Court assumes no risk or liability for any injury to any member of your party, except that which is as a result of our negligence.

10.  SMOKING

10.1  Smoking is strictly prohibited in or around the treehouses.

11.  FIRE/CANDLES

11.1  For obvious reasons, candles and naked flames are prohibited in or around the treehouses due to the fire risk. However, a number of the treehouses include a brazier and indoor wood burners for your use.  These can of course be dangerous and must be used with due care and attention, particularly if children are present.  Use of the braziers and wood burners is solely at your own risk.

11.2  Please do not place anything on the wood burner or cook anything outside the kitchen. If you’re unsure of what is allowed, please contact us using the “In case of Emergency number".

11.3  At certain times of the year use of the brazier will not be permitted for safety reasons – for example, if there is a risk of sparks setting light to the woodlands. We will notify you on arrival if this is the case during your stay. 

12.  DAMAGE / BREAKAGES

12.1  You are responsible for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join you as part of your booking. For example, this means you are responsible for leaving the treehouse(s) (and its contents) in the condition it was in when you arrived.

12.2  Please take care of our precious treehouses and surrounding woodland. You are responsible and liable for any breakages or damage to accommodation or its contents. We do not ask for a deposit and therefore kindly ask that you report any damage or breakages when they occur. We reserve the right to charge for repairs or replacements of broken or damaged items.

12.3  Please leave the treehouses clean and tidy. We reserve the right to charge you additional cleaning charges after your departure if this is not the case.

13.   NOISE

13.1  We request that the noise is kept to a minimum. This is a secluded place with wild animals and nature in close vicinity. There are also other guests close by.

13.2   We reserve the right to ask guests to leave the premises if they are disturbing the peace or enjoyment of others or causing a disturbance that affects other guests also staying in the woods.

14.  ADDITIONAL DAY/EVENING GUESTS

14.1  The booking of your treehouse(s) is strictly for the number of guests set out on your booking. You must not invite additional day or evening guests to your treehouse without our prior consent.

15.  PARKING

15.1  Parking facilities are available on site, but any vehicles and their contents are left solely at the owner’s risk. We do not accept liability for any damage to or loss of possessions whilst on site.

15.2  Each treehouse has its own exclusive car park which has space for 2 cars.

16.   BOUNDARIES

16.1  Please be mindful that the treehouses are adjacent to and overlooking an area of land that we are returning to nature. As such please stick to paths that have been clearly signed and respect that the land and the flora and fauna on it are sensitive to noise, mess and any other disrespectful behaviour (which may be unconscious).

16.2  Please do not venture into the area of any other treehouse as there will be other guests expecting a secluded and private time.

16.3  Elmore Court is a private wedding and events venue and the house and grounds are strictly out of bounds (unless you are a guest of the wedding). Please never enter the grounds of Elmore Court without our express prior permission.

17.  GENERAL

17.1  Intellectual Property: We reserve all copyright and any other intellectual property rights which are used in connection with the Elmore Court Treehouses.  We reserve the right to take such actions as may be appropriate to restrain or prevent infringement of such intellectual property.

17.2  Data Protection: We will use personal information provided by you to us to provide access to the treehouse you have booked, and to facilitate your stay.  Our handling of such data will be in accordance with our privacy policy (a copy of which is displayed on our website).

17.3  Variation: We reserve the right to update these terms and conditions from time to time, and shall notify you of any updates at the relevant time.

17.4  Governing law and jurisdiction: These terms and conditions shall be governed in all respects by the laws of England and the parties submit to the exclusive jurisdiction of the English Courts.

17.5  Assignment and sub-contracting: You acknowledge that Elmore Court is permitted to assign, transfer, charge or otherwise deal with all or any of its rights and/or obligations under or related to these terms, or to sub-contract the performance of any of its obligations without requiring your prior consent.
